2. Scope

These Terms and Conditions of Sale apply to all sales concluded through the website between the Seller and any private or business customer. By placing an order, the customer fully and unconditionally accepts these Terms and Conditions of Sale.


3. Products

The website offers, in particular, model kits for assembly, accessories, tools, consumables, merchandise and other products related to model building, creative hobbies and pop culture.

Products may belong to different licences, brands or universes. The descriptions, specifications and photographs shown on the website are intended to provide customers with information that is as accurate as possible.

Photographs, illustrations, colours and product representations are provided for information purposes only and are not contractually binding. Slight differences may occur, in particular due to manufacturing, packaging or screen display conditions.


4. Safety and Age Restrictions

Some products offered on the website may contain small parts that could present a choking hazard to young children. Customers are responsible for following the age recommendations and safety instructions shown on the packaging or in the product documentation.

The Seller cannot be held liable for any use of a product that does not comply with the manufacturer’s recommendations.


5. Prices

Prices are shown in CHF (Swiss francs), including VAT where applicable, excluding delivery charges.

The Seller reserves the right to change prices at any time.

Products are invoiced at the price applicable at the time the order is placed.

Despite the care taken to keep the website up to date, obvious pricing or description errors may occur. The Seller reserves the right to cancel an order affected by an obvious error and to refund all amounts paid in full.


6. Orders

The ordering process includes:

  • selecting the products.
  • reviewing and confirming the shopping cart.
  • entering customer information.
  • accepting these Terms and Conditions of Sale.
  • making payment.

An order is considered final once payment has been confirmed.

The Seller reserves the right to refuse or cancel any order in the event of:

  • a payment dispute.
  • suspected fraud.
  • a stock shortage.

7. Payment

Payments are secure and may be made using:

  • credit or debit card.
  • TWINT.
  • digital wallets such as Google Pay, Apple Pay or Link.
  • any other payment methods offered on the website.

The goods remain the property of the Seller until full payment has been received.

Orders are only shipped once payment has been confirmed.


8. Product Availability

Products are offered subject to availability.

If a product becomes unavailable after an order has been placed, the customer will be informed. The customer may then choose between a refund or, where possible, an equivalent replacement product.


9. Pre-orders

Products offered for pre-order are products that are not yet in stock at the time the order is placed.

Any availability and delivery dates communicated at the time of the pre-order are estimates only. They depend in particular on manufacturers, distributors and carriers and may be changed or postponed without giving rise to any right to compensation.

All pre-orders are firm and final. Once the order has been placed and payment completed, the pre-order cannot be cancelled or refunded at the customer’s request, subject to any mandatory legal provisions that may apply.

A delay or postponement of the availability date announced by the manufacturer or distributor does not, in itself, constitute grounds for cancellation or refund of the pre-order.

As quantities allocated by manufacturers or distributors may be changed, the Seller cannot guarantee the final availability of products offered for pre-order. If the Seller is ultimately unable to supply the pre-ordered product, the pre-order will be cancelled and all amounts paid for the affected product will be refunded in full to the customer.


10. Delivery

Deliveries are made within Switzerland.

Estimated delivery time: 2 to 5 business days.

Delivery charges are calculated at checkout.

The Seller cannot be held responsible for delays caused by the carrier.

Under no circumstances shall delivery delays give rise to any claim for damages and/or a right to terminate the contract. In accordance with Swiss law, risk passes to the customer once the shipment has been handed over to the carrier. All products ordered will be delivered to the address provided by the customer.


11. Receipt of Products

Any visible defect, transport damage or delivery error must be reported to the Seller within 5 business days of receipt of the order, accompanied where possible by photographs showing the issue.

Defects that could not reasonably have been detected upon receipt must be reported as soon as they are discovered.


12. Returns and Refunds

Under Swiss law, purchases made through our online store are not subject to a statutory right of withdrawal.

Products whose packaging has been opened or damaged, or whose seals have been removed, cannot under any circumstances be returned or exchanged, except in the event of a confirmed product defect or an error attributable to the Seller.


13. Warranty

Customers benefit from the statutory warranty rights for defects in accordance with the Swiss Code of Obligations.

Where a defect is confirmed, the Seller may, at its discretion, replace the affected product, refund the purchase price or grant an appropriate price reduction.


14. Liability

The Seller cannot be held liable for:

  • incorrect assembly of models or kits.
  • improper use of products.
  • failure to follow the manufacturer’s recommendations.
  • indirect damage resulting from the use of the website or the products.

15. Force Majeure

The Seller cannot be held liable for any failure or delay in performing its obligations resulting from an event reasonably beyond its control, including natural disasters, pandemics, armed conflicts, strikes, disruption of transport networks, interruption of telecommunications services, supplier failures or any other circumstance considered to constitute force majeure.

17. Intellectual Property

All content created by the Seller and available on the website, including texts, photographs, logos, graphic elements and the structure of the website, is protected by applicable intellectual property laws.

Any reproduction, representation, modification or use of such content, in whole or in part, without the Seller’s prior written consent is prohibited.

Trademarks, logos, product names and visual materials belonging to third parties remain the property of their respective owners and are used solely for the purpose of identifying and presenting the products offered for sale.


18. Governing Law

These Terms and Conditions of Sale are governed by Swiss law.

In the event of a dispute, the parties will first endeavour to reach an amicable settlement before initiating legal proceedings.

If no amicable agreement can be reached, the competent courts will be determined in accordance with the applicable legal provisions. Any mandatory jurisdictions provided for under Swiss law, particularly in matters of consumer protection, remain reserved.
